Washington is a bifurcated state. BBPA arbitration can apply to qualifying claims under OIC-regulated plans and self-funded plans that elect participation.
Plan and jurisdiction considerations
Confirm OIC regulation or self-funded opt-in, then test service and provider/facility eligibility. A third-party administrator's identity alone does not establish jurisdiction.
Federal fallback
Federal IDR generally applies to eligible self-funded claims without a Washington election and claims outside BBPA's payment method.
Timing and fees
OIC states that arbitration must generally be initiated no later than 10 calendar days after good-faith negotiation and that parties split arbitration cost; confirm the current form because eligibility and procedural dates are claim-specific.

Air ambulance disputes generally remain within Federal IDR when eligible.
