Virginia is a bifurcated state. State arbitration may apply to protected emergency and certain facility-based services under regulated plans and self-funded plans that opt in.

Plan and jurisdiction considerations

Confirm Virginia jurisdiction or a documented self-funded election, along with service and facility scope. Non-opted-in ERISA self-funded plans ordinarily remain federal.

Federal fallback

Federal IDR generally applies to eligible self-funded claims without a Virginia opt-in and other state-law gaps.
