State IDR guide

New Hampshire Independent Dispute Resolution Guide

Responsible agency
New Hampshire Insurance Department
Review date

New Hampshire is a bifurcated state. State law can establish payment treatment for certain out-of-network services covered by New Hampshire-regulated plans.

Plan and jurisdiction considerations

Determine whether the plan is regulated by New Hampshire and whether the service and facility fall within state law. Self-funded ERISA plans ordinarily require federal routing.

Federal fallback

Federal IDR is available for otherwise qualified claims where the state law does not set the payable amount.

Timing and fees

State review and dispute procedures have their own filing requirements. Confirm current Department timing and cost information before relying on a deadline.

Air ambulance considerations

Air ambulance disputes generally use Federal IDR when eligible.
